- Submit knowingly false or misleading information through Club forms;

- Use the Club's name, seal, logo, photographs, graphics, or other intellectual property in a manner that falsely suggests sponsorship, endorsement, membership, or authorization.

We reserve the right to restrict or terminate access to the website when reasonably necessary to protect the Club, its members, visitors, systems, or legal interests.

4. MEMBERSHIP

Submitting a membership application, inquiry, payment, or other information through this website does not automatically guarantee membership in THE R&B SOCIAL CLUB OF INDIANA, INC.

Membership is subject to the Club's Articles of Incorporation, Bylaws, policies, eligibility requirements, application procedures, membership classifications, dues requirements, and other rules adopted by the Club.

Where information on this website conflicts with the Club's duly adopted governing documents, the applicable governing documents and formally adopted policies shall control to the extent permitted by law.

The Club reserves the right to approve, deny, suspend, terminate, or otherwise administer membership in accordance with its governing documents and applicable law.

5. MEMBERSHIP DUES AND FEES

Membership dues, assessments, application fees, event charges, and other Club-related payments are subject to the rates and conditions disclosed at the time of payment.

Payment of membership dues does not create an ownership interest in the Club.

Membership dues and fees are subject to the Club's applicable refund, cancellation, membership, and financial policies.

Unless expressly stated otherwise in writing, dues associated with an already-active membership period may be nonrefundable to the extent permitted by applicable law and Club policy.

6. EVENT TICKETS AND REGISTRATIONS

The Club may sell or distribute tickets or registrations for social events, fundraisers, community programs, private functions, trips, workshops, entertainment events, and other activities.

Event-specific rules may apply in addition to these Terms.

Event dates, times, venues, entertainment, menus, speakers, programming, schedules, and other details may be changed when reasonably necessary.

Tickets may be nontransferable or nonrefundable when clearly identified as such at the time of purchase, subject to applicable law and any event-specific refund policy.

The Club may refuse admission or remove an attendee when reasonably necessary for safety, security, substantial rule violations, unlawful conduct, or material disruption of an event, subject to applicable law.

7. PAYMENTS

Payments made through the website may be processed by third-party payment providers.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable transaction.

The Club does not guarantee the availability, performance, or security of an independent third-party payment provider.

Any payment processing fees, taxes, or other charges will be disclosed when applicable.

8. DONATIONS, FUNDRAISING AND CONTRIBUTIONS

The Club may conduct fundraising campaigns or accept contributions through the website.

Unless specifically stated otherwise, a payment to the Club should not be assumed to constitute a tax-deductible charitable contribution.

Donors and contributors are responsible for consulting their own tax or financial professionals regarding the deductibility or tax treatment of any payment or contribution.

The Club will not knowingly make representations regarding tax deductibility that are inconsistent with its applicable tax classification.

9. COMMUNITY PROGRAMS

The Club may provide information about community-service projects, educational initiatives, youth programs, outreach activities, volunteer opportunities, and partnerships through this website.

Participation may require additional applications, permission forms, waivers, eligibility requirements, parental or guardian authorization, codes of conduct, or program-specific agreements.

Program-specific documents will supplement these Terms.

10. MINORS

The general membership portions of this website are not intended to solicit Club membership from minors.

The Club may, however, sponsor or participate in youth-oriented community and educational programs.

When information concerning a minor is required for participation in such a program, the Club may require authorization from a parent or legal guardian and will endeavor to handle that information in accordance with applicable law and Club privacy practices.

11. PHOTOGRAPHY, VIDEO AND MEDIA

Club events and activities may be photographed, recorded, livestreamed, or otherwise documented.

Where applicable, separate notices, releases, registration terms, or event signage may govern the Club's use of a participant's name, photograph, image, likeness, voice, or recorded appearance.

Nothing in these website Terms by itself requires a person to surrender rights that applicable law requires to be separately authorized.

12. INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its original content—including the Club's name, seal, logos, designs, graphics, photographs owned by the Club, publications, written materials, promotional materials, and other original content—are owned by or licensed to THE R&B SOCIAL CLUB OF INDIANA, INC.

Such materials may be protected by copyright, trademark, and other applicable intellectual-property laws.

No Club seal, logo, insignia, graphic, or other protected material may be reproduced, modified, distorted, sold, commercially distributed, or represented as official Club material without authorization.

Nothing on this website grants a license or ownership interest in Club intellectual property except where expressly stated in writing.

13. USER-SUBMITTED CONTENT

If you submit photographs, testimonials, comments, documents, suggestions, or other material to the Club, you represent that you have the right to submit that material.

Any permission for the Club to publicly reproduce or distribute submitted material will be governed by the authorization provided when the material is submitted and applicable law.

You may not knowingly submit content that infringes another person's intellectual-property, privacy, publicity, or other legal rights.

14. THIRD-PARTY WEBSITES AND SERVICES

The website may contain links to social-media platforms, ticketing services, payment processors, sponsors, community partners, vendors, governmental entities, or other third-party websites.

These websites and services are independently operated.

The Club does not control and is not responsible for the content, security, availability, privacy practices, terms, or conduct of independent third-party websites.

A link does not necessarily constitute an endorsement unless the Club expressly states otherwise.

15. PRIVACY

The Club respects the privacy of website visitors, members, applicants, program participants, donors, volunteers, and event attendees.

Personal information submitted through this website will be handled in accordance with the Club's applicable Privacy Notice and applicable law.

Users should review the Privacy Notice to understand what information may be collected, why it is collected, how it may be used or disclosed, and the choices that may be available concerning personal information.

16. WEBSITE INFORMATION

The Club strives to provide accurate and current information. However, occasional errors, omissions, outdated information, technical issues, or typographical errors may occur.

We reserve the right to correct errors and update website content without prior notice.

Information appearing on the website does not amend the Club's Articles of Incorporation, Bylaws, resolutions, contracts, or formally adopted policies unless expressly stated.

17. NO PROFESSIONAL ADVICE

Information provided through this website is for general informational purposes.

Nothing on the website constitutes legal, tax, accounting, medical, financial, or other professional advice.

Users should consult an appropriate qualified professional regarding decisions requiring professional advice.

18. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis.

The Club does not warrant that the website will always be uninterrupted, error-free, secure, or free from harmful components.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

19. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, THE R&B SOCIAL CLUB OF INDIANA, INC., and its directors, officers, authorized representatives, volunteers, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from the use of or inability to use this website.

This provision does not limit liability that cannot legally be limited or excluded under applicable law.

Additional waivers or liability provisions may apply to particular events, programs, trips, or activities.

20. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless THE R&B SOCIAL CLUB OF INDIANA, INC. and its directors, officers, representatives, volunteers, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful use of the website, your material violation of these Terms, or content you knowingly submit in violation of another person's rights.

21. CLUB GOVERNANCE

These Terms govern use of the website and do not replace the Club's Articles of Incorporation, Bylaws, membership policies, codes of conduct, resolutions, or other duly adopted governing documents.

Members remain subject to applicable Club governing documents independently of these website Terms.

22. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

Any dispute concerning these Terms shall be handled in an appropriate court having jurisdiction under applicable law.

23. SEVERABILITY

If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent legally permissible or severed as appropriate.

The remaining provisions shall continue in effect.

24. NO WAIVER

Failure by the Club to enforce a provision of these Terms on one occasion does not constitute a permanent waiver of that provision or any other right.

25. CHANGES TO THESE TERMS

The Club may revise these Terms periodically to reflect changes in its website, operations, programs, policies, or applicable legal requirements.

The revised Terms will be posted on this website with an updated “Last Updated” date.
